If you do not agree to these Terms, please do not use the Site or place any orders. These Terms apply to all visitors, customers, and other users of the Site. Mayfair Export reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

2. Products, Pricing and Availability

All products listed on the Site are subject to availability. Mayfair Export reserves the right to discontinue any product at any time without notice. Prices displayed on the Site are in Canadian dollars unless otherwise specified and are subject to change without notice. We make every effort to display accurate pricing; however, in the event of a pricing error, we reserve the right to cancel or refuse an order placed at the incorrect price and will notify you promptly. Taxes, shipping, and handling charges are not included in listed prices unless explicitly stated and will be calculated and displayed prior to order confirmation. Product images and descriptions are provided for informational purposes; actual products may vary slightly from images shown.

3. Orders and Payment

By placing an order on the Site, you represent that you are of legal age in your jurisdiction and that the information you provide is accurate and complete. All orders are subject to acceptance by Mayfair Export. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, inaccurate information, or unavailability of the product. Payment is due at the time of order placement unless alternative arrangements have been agreed upon in writing. For large commercial orders, custom payment terms may be available — contact us to discuss. Mayfair Export uses secure third-party payment processors and does not store full credit card information on our systems.

4. Shipping and Delivery

Due to the nature of heavy industrial and construction equipment, shipping and delivery require specialized logistics. Delivery timelines are estimates only and may be affected by factors outside our control, including carrier delays, weather conditions, and customs procedures for international shipments. Risk of loss and title for items purchased from Mayfair Export passes to the buyer upon delivery to the carrier. It is the buyer's responsibility to inspect the equipment upon delivery and to report any visible damage to the carrier and to Mayfair Export within 48 hours of receipt. Delivery is typically made to a ground-level accessible location; placement beyond this may require additional arrangements and may incur additional charges. For international orders, the buyer is responsible for all import duties, taxes, and compliance with local regulations.

5. Returns and Refunds

Given the size, weight, and cost of heavy industrial equipment, our return policy differs from standard retail returns. Returns must be requested within the time period specified at the time of purchase. To be eligible for return, equipment must be unused, in original condition, and in original packaging where applicable. Items that have been operated, assembled, modified, or damaged after delivery are not eligible for return. A restocking fee of up to 20% may be applied to eligible returns of heavy or oversized equipment to cover handling, inspection, and repackaging costs. Return shipping costs are the responsibility of the buyer unless the return is the result of a product defect or a fulfillment error by Mayfair Export. Refunds, where approved, will be issued to the original payment method within a reasonable timeframe after the returned item has been received and inspected. Custom-ordered or special-procurement items may be non-returnable — this will be communicated at the time of purchase.

6. Warranty Disclaimer

New equipment sold by Mayfair Export is typically covered by the manufacturer's warranty. Warranty terms, coverage, and duration vary by manufacturer and product. Mayfair Export acts as a reseller and distributor and is not the manufacturer of the equipment sold on this Site. As such, warranty claims are subject to the terms set by the original manufacturer and must be handled in accordance with the manufacturer's warranty process. Mayfair Export will assist clients in accessing manufacturer warranty support where possible. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAYFAIR EXPORT MAKES NO ADDITIONAL WARRANTIES, EXPRESS OR IMPLIED, BEYOND THOSE PROVIDED BY THE MANUFACTURER.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Mayfair Export shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any products purchased, or any services provided, even if advised of the possibility of such damages. In no event shall our total liability to you for any claim exceed the amount paid by you for the specific product or service giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario. If you are accessing the Site from outside Canada, you are responsible for compliance with your local laws and regulations.
